Business profiles and content

1. Unclaimed business listings

Degusty may create listings for establishments open to the public containing factual business information: name, address, location, category, published contact details and opening hours. This information may come from public sources, open data directories or fieldwork carried out by our team.

An unclaimed listing does not imply any commercial relationship, affiliation, sponsorship or endorsement by the business. Any business may claim its listing at any time and free of charge, and may also request corrections without claiming it.

2. Claiming a profile and declaration of authority

Whoever claims a profile declares that they own the business or hold sufficient authority to represent it, on the same terms as section 3 of the Terms and Conditions.

The claim may be made from any email account belonging to the person representing the business. Linking the profile to a specific corporate account is a separate technical step that may be completed later or not at all: what the claim records is who performed the act, not which email address was used.

Degusty may verify ownership by phone, email, physical presence or other reasonable means, and may set aside a claim where there are indications that it was made without the business authority.

3. Content published on the profile before the claim

Some of the content on a profile may have been published by the Degusty team or taken from the public social media accounts of the business before the business had an account on the platform. This occurred during the early stage of the service, in order to display the business in the application.

By claiming the profile and accepting this document, the business expressly ratifies and authorises that content, which becomes covered by the licence established in section 5 of the Terms and Conditions, on the same terms and with the same limits.

This ratification creates no additional obligations and implies no waiver: ratified content may be removed at any time under section 6 of this document.

A business that prefers not to ratify that content may still claim its profile and request the removal of the material, before or after the claim, without losing the profile or its associated features.

4. Scope of the licence

This document does not grant a licence separate from the one set out in section 5 of the Terms and Conditions. For clarity, that licence covers the operations necessary to provide the service, including:

• Hosting the content and generating optimised versions, thumbnails, crops and transcodings required to display it.
• Displaying the content within the application, on degusty.com and on links.degusty.com.
• Attributing the content to the corresponding business profile.

The licence is non-exclusive, does not transfer ownership of the content, does not authorise selling it to third parties or using it in advertising for third parties unrelated to the business, and is revocable under section 6.

5. Publishing through @degustyapp mentions

When a business mentions or tags @degustyapp from its official Instagram account, that post may be reproduced on the business profile on Degusty. The mention is a voluntary act by the business and constitutes authorisation to publish that content under the same licence described in section 4.

This path applies only to mentions made from the official account of the business. Degusty keeps a record of every mention received, including the originating account, the date and the associated material.

Content published through this path may be removed under section 6, and ceasing to mention @degustyapp stops the publication of new content.

6. Content removal and revocation

The business may request at any time the removal of content published on its profile, by writing to the address given at the end of this document from a contact channel associated with the business or from the account that manages the profile.

We will act on the request promptly and, in any event, within five (5) business days of receiving it. No justification is required.

For technical reasons, copies stored in caches or content delivery networks may remain accessible for a short additional period, and content previously shared or downloaded by third parties is beyond the control of Degusty.

7. What is not removed

A removal request covers the creative material associated with the business: photographs, videos, texts and posts. It does not cover:

• Ratings, reviews and comments published by users. These are not business content but third-party opinions, and are governed by sections 7 and 8 of the Terms and Conditions: they are moderated or removed when they breach platform policy, not at the request of the business being rated.
• The factual information of the listing: name, address, location, category, opening hours and contact details published by the business itself. It corresponds to an establishment open to the public and may remain published even if the profile is unclaimed or a claim is set aside.
• The internal audit and consent records described in section 8, which are retained precisely in order to evidence what was authorised and when.

If the establishment ceases to operate, the business may request that its listing be marked as closed.

8. Consent record

For each acceptance of this document we retain:

• The account that performed the acceptance and the declared business profile.
• The date and time, the IP address and the user agent from which it was performed.
• The version of this document, a full copy of the accepted text and its cryptographic fingerprint (hash), so that the exact text accepted can be retrieved even if the published document changes later.

This record exists because the law requires it: article 53 of the Venezuelan Copyright Act requires use licences to be recorded in writing, and the Decree with Rank and Force of Law on Data Messages and Electronic Signatures grants data messages the same evidentiary effect that the law grants to written documents.

9. Distinctions and benefits associated with the claim

Degusty may grant in-platform distinctions, such as "Verified" or "Founder", and courtesy credits to businesses that claim their profile. These are discretionary commercial benefits, subject to availability, to the programme rules in force and to modification or discontinuation.

These benefits are not consideration for the content licence and in no way condition the right of the business to request removal under section 6.

10. Versions of this document

Each version of this document is published with its update date and kept accessible. A recorded consent always refers to the version in force at the time of acceptance.

Where a change materially alters the scope of the licence or the removal conditions, a new acceptance will be requested rather than applying the change retroactively.

Section 21 of the Degusty Terms and Conditions applies.
